1. INTRODUCTION

WayTalk is a social community platform that allows users to create accounts, publish content, interact with other users, add parking locations, post listings, and record route-related information.

We are committed to protecting personal data and ensuring transparency in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection laws.

This Privacy Policy explains how personal data is collected, used, stored, anonymized, and deleted.

3. DATA WE COLLECT

3.1 Account Information

When creating an account, we collect:
- Email address
- Username
- Internal user ID

Legal basis: Article 6(1)(b) GDPR (performance of a contract).
Providing this data is voluntary but necessary to use the service.

3.2 User-Generated Content

Users may publish:
- Posts
- Comments
- Listings
- Route entries
- Other voluntarily submitted content

Such content may be publicly visible within the platform.

3.3 Location Data

With explicit consent, WayTalk may access precise device location while the app is actively in use (foreground only).

Location data is used to:
- Add parking locations
- Display location-based features

Location data is not collected in the background.

Legal basis: Article 6(1)(a) GDPR (consent).

3.4 Technical and System Data

We may automatically collect:
- IP address
- Device identifiers
- Device type
- Operating system
- App version
- Diagnostic data
- Crash logs

Legal basis: Article 6(1)(f) GDPR (legitimate interest in security and system integrity).

4. PURPOSES OF PROCESSING

We process personal data to:
- Provide and maintain user accounts
- Enable social interaction
- Ensure system security
- Prevent abuse and fraud
- Improve application performance
- Fulfill legal obligations

We do not sell personal data.
We do not use personal data for behavioral advertising.
We do not engage in automated profiling.

5. DATA RETENTION

Personal data is retained for the duration of account activity.

Upon account deletion:
- Email address and account identifiers are permanently deleted.
- The connection between the user and their published content is permanently removed.
- Publicly published content may remain in anonymized form.

6. ACCOUNT DELETION

Users may delete their account directly within the app via the “Delete Account” function.

Account deletion results in:
- Permanent removal of identifying data (email, user ID)
- Irreversible anonymization of public content
- Removal of authentication credentials
- Loss of access to the account

Deletion is irreversible.

7. ANONYMIZATION OF CONTENT

WayTalk operates as a community platform. To preserve discussion integrity and community continuity:
- Public posts and comments may remain visible after account deletion
- The username is replaced with a neutral label (e.g., “Deleted User”)
- All technical links between the content and the deleted account are permanently removed
- No internal mapping is retained that would allow re-identification of the user

After anonymization, the remaining content no longer constitutes personal data, as it cannot be linked to an identifiable individual.

8. RIGHT TO ERASURE (ARTICLE 17 GDPR)

Users have the right to request erasure of personal data.

However, under Article 17(3) GDPR, the right to erasure does not apply where processing is necessary for:
- Exercising freedom of expression and information
- Establishing, exercising, or defending legal claims
- Legitimate interests overriding the request

If user-generated content contains additional personal data that directly identifies the individual (e.g., full name, phone number), such content may be subject to removal upon justified request.

9. BACKUPS

Deleted personal identifiers may temporarily remain in encrypted backup systems strictly for disaster recovery purposes.

Backup data is automatically overwritten and is not actively processed.

10. DATA SHARING

Personal data may be shared only with:
- Infrastructure providers (e.g., Supabase)
- Technical service providers necessary for operation
- Public authorities where required by law

All processors operate under appropriate data processing agreements.

11. INTERNATIONAL DATA TRANSFERS

Where data is processed outside the European Economic Area (EEA), appropriate safeguards are implemented, including Standard Contractual Clauses (Article 46 GDPR).

12. Advertising and Sponsored Content

Our application may display advertising content and sponsored placements provided directly by our business partners ("sponsored ads"). These ads are integrated into the app interface (for example, within dashboard sections or designated content areas) and are clearly distinguishable from core application functionality.

We do not use third-party advertising networks such as Google AdMob or similar platforms at this time. Advertising content shown in the app is managed directly by us and our partners.

We do not use personal data of users for behavioral advertising, profiling, or cross-app tracking. Ads displayed within the app are not personalized based on sensitive personal data, and we do not sell or share personal data with advertisers for targeting purposes.

However, we may use limited, non-personal or aggregated information (such as general app usage patterns, device type, or geographic region at a high level) to improve the relevance, placement, and performance of advertising content.

We may also collect and share anonymized or aggregated statistics with advertisers, such as the number of ad views or general engagement metrics. These statistics do not allow advertisers to identify individual users.

Advertising content may include links to external websites or services operated by third parties. We are not responsible for the privacy practices or content of those external services, and users should review their respective privacy policies.

If our advertising model changes in the future (for example, by introducing third-party advertising networks or personalized advertising), this Privacy Policy will be updated accordingly, and additional user consent may be requested where required by applicable law.

13. USER RIGHTS

Users have the right to:
- Access their data
- Rectify inaccurate data

- Restrict processing
